While leafing out the past pages of constitutional stub we can realize various provisions endorsed are detaining our sovereignty, independence, self-esteem and diplomatic power. A weird and humorously unique citizenship policy (2020 and 2063) is one of the vibrant example of diplomatic weakness and international disparagement. According to clause 5.1 citizenship act 2063
-Foreign women can obtain naturalized citizenship immediately after marriage.
-Foreign women after claiming she shove off citizenship of her native land can immediately proceed to Nepal's citizenship.
-There is no citizenship provision for foreign men marrying Neplease women who come to hunker down to Nepal.
IT'S vivid that this provision is against our independence, sovereignty and equality even to the blindfolders folding their eyes with Indian propoganda and women leaders barking against gender ineqality. Recently, the vision and action of Indian daughter Sarita Giri (member of parliament and a leading member of Janata Samajwadi party) known to be "Nepali Buhari" against Nepal sovereignty on territorial issue has made parliamentary panel, legend and entire Nepalese sensitive on the issue of citizenship and political right. So, recently to restrain other Sarita Giri on behalf of Nepal's integrity the concern issue was bought upto the discussion panel by the ruling NCP. In a fresh move by Nepal's lawmakers, the parliamentary state affairs and good governance committee on Sunday endorsed an amendment bill to the citizenship act 2063 which would make it compulsory for a foreign women married to Nepali men to wait for seven years to aquire naturalized citizenship.
But even in such issue of National sovereignty and nationality, different political parties are putting their heart into their sleeves and giving their lines surfacing news portals, channels and mint editorials. So, the Amendment of clause 5.1 citizenship act (2063) passed through parliamentary panel is still being a contentious provision. According to Some emerged unions(Janata Samajwadi party) and legend "such instinct action immediately after border extension may completely break the bridge between Nepal and India. This change is directly provoking against roti-beti relationship between Nepal and India. The government is overplaying it's role for popularity which supports gender ineqality, women violence and molestation. On the other hand, this instigation is ruled to dominate Indian Brides as refugees. So the provision on citizenship must be as it was since 2019 to as of now. With such petition Janata Samajwadi party has decided to flood down to road in every headquarters from 16 Ashar against the amendment.
On the other hand, Nepali congress after long discussion and analysis came to reconciliation on the amended issue with a next provisional application on behalf of foreign male married to Nepali women to obtained naturalized citizenship either after seven or even after 15 years with impartiality to both gender. According to Nepali congress "the parliamentary panel while finalizing the Provision must give a soft spot to impartiality on the change. It would be unpointable and unblameable if the amended law could address foreign male too."
IF we go through all these contention and politicalization even on such matter of nationality, then don't you think we ourself are digging our legs with an axe? Constitutional bill amendment on citizenship which was attempted 2 years ago is now very colse to finish-line, action and reaction on the matter is languishing. While visiting the constitutional policy of south Asian countries and even European countries, there is strict rule for foreign brides or foreigners. Even our frontier India has provision of seven year residence to Nepali daughters married to India only to apply for their citizenship. Then is there any reason for making a big fuss? Is Nepal's citizenship a sweet which can be distributed freely? Are we doing any wrong attempt against India to cut off the bridge? No we are only safeguarding our right and esteem. And also this law is not aimed only to Indian also to every foreigners from other countries also to Chinese. On the other hand the amended provision has also addressed about national identity card to foreign daughters till their eligibility to Nepal citizenship through which they can enjoy social, cultural, structural, property and marital right expect political right and position in goverment reservations.
The next claim on impartiality on gender for citizenship is quite confusing and even humorous. By endorsing the power of foreign male on citizenship after marriage, do we want to encourage Saroj Giri to ploy against our land? OF course not. So in case if this amendment is dismissed or another came into account or same precedent law rule over us again then it's sure that various social disorder, crimes, relation clash and tendency of fake marriage only for citizenship will pop up.
